Burgess & Niple was retained by our client to perform a Phase I and II ESA and risk assessment under Ohio EPA Voluntary Action Program (VAP) Protocol. The 14-acre site was operated as an industrial parcel since the 1890s in the manufacturing of steel, welding, batteries, and varnish. The client wanted to dispose of this orphan property and decided to assess the environmental impact on a voluntary basis. The VAP offered protection from EPA enforcement during the study, and a Covenant Not to Sue would benefit both the client and a prospective buyer. The proposed land use is luxury multifamily residential housing.
